Sec. 483.10 Resident rights.
(b) Notice of rights and services.
(5) The facility must--
(i) Inform each resident who is entitled to Medicaid benefits, in writing, at the time of admission to the nursing facility or, when the resident becomes eligible for Medicaid of--
(A) The items and services that are included in nursing facility services under the State plan and for which the resident may not be charged;
(B) Those other items and services that the facility offers and for which the resident may be charged, and the amount of charges for those services; and
(ii) Inform each resident when changes are made to the items and services specified in paragraphs (5)(i) (A) and (B) of this section.
(7) The facility must furnish a written description of legal rights which includes-
(ii) A description of the requirements and procedures for establishing eligibility for Medicaid, including the right to request an
assessment under section 1924(c) which determines the extent of a couple's non-exempt resources at the time of
institutionalization and attributes to the community spouse an equitable share of resources which cannot be considered available for payment toward the cost of the
institutionalized spouse's medical care in his or her process of spending down to Medicaid eligibility levels;

The nursing home is responsible for telling you about Medicaid.
The nursing home must give you a list of the things that Medicaid will pay for. The nursing home can't charge you or your family anything extra for these things.
The nursing home must tell you the things that Medicaid will not pay for and how much these things would cost if you or a family member chooses to pay for them.
The nursing home must tell you of any changes are made in the things Medicaid will pay for or changes in the cost of things Medicaid will not pay for.
The facility must tell you how to apply for Medicaid.
The husband or wife of a resident who becomes eligible for Medicaid is allowed to keep certain assets such as a home, car, and income. The nursing home must inform the spouse of this provision and the right to an assessment to determine if they are eligible for it.
